1. General information on social media platforms
We would like to point out that you use our social media pages and their functions as well as the social media platforms as a whole on your own responsibility. This applies in particular to the use of the interactive functions (e.g. liking, following, commenting, sharing, rating). For further information on use, please refer to the terms of use and privacy statements of the social media platforms.
We expressly draw your attention to the fact that the Provider stores data of registered users (hereinafter “Users”) and other interested visitors of the social media platform (hereinafter “Visitors”), e.g. personal information, IP address, cookies, etc., also outside the European Union (EU) or the European Economic Area (EEA) and uses them for its own business purposes.
We generally have no influence on the data collection and its further use by the provider. To what extent, where and for how long the data is stored, to what extent the provider complies with existing deletion obligations, what evaluations and links are made with the data and to whom the data is passed on, is neither recognizable nor influenceable for us. We therefore ask you to carefully examine what personal data you disclose as a user on the social media platform.

2. Nature, scope, purposes and legal basis of data processing
We operate our social media site to inform users and visitors about our company and to exchange information with them. Unless otherwise described below, your data is processed on the basis of our legitimate interests (Article 6 (1) (f) DSGVO) in the economic operation, optimization and usage analysis of our social media site and to communicate with you as a user/visitor and to carry out advertising activities on the social media platform.
The use of our social media site is partly possible without registration with the social media platform. Even if you use the social media platform without registering, personal data may be processed.
Below you will find an overview of the type, scope, purposes and, if applicable, specific legal bases of data processing in the context of the use of our social media site.
2.1 Usage analysis
In connection with the operation of our social media site, we use the “Insights” or “Analytics” function of the social media platform, by means of which the provider provides us with statistical data on the use of our social media site, which are anonymous for us, i.e. the personal data of individual users or visitors are not visible to us. We do not know in detail which data the provider uses for usage analysis in connection with our social media site.
From Facebook and Instagram, we receive aggregated data on the following areas in particular: Activity (e.g., interactions such as profile visits and website clicks, or the number of people who see content and where they find it), Content (analytics about posts, stories, and promotions), and Audience (demographics about subscribers and other visitors).
- From LinkedIn, we receive aggregated data on the following areas in particular: Reach (impressions, page views, unique users, subpage views), audience (demographics), interaction (impressions, reactions, click-through rate, likes, shares, comments, (link) clicks, engagement rate), audience (location, job function, company size, industry and seniority).
2.2 Cookies
The providers of the social media platforms use cookies and cookie-like technologies, i.e. usually small files that are stored on your end device (hereinafter collectively referred to as “cookies”), among other things to offer you a comprehensive range of functions, to make use more convenient and to be able to optimize its offer. The data obtained by means of cookies are stored and processed directly by the provider. We ourselves have no access to these and no influence on how the provider uses them.
The information obtained by means of cookies may be used by the provider within the social media platform as well as in other provider services and in services of third parties that use the provider services to create usage profiles for market research and advertising purposes. In particular, your usage behavior and your resulting interests are taken into account here. In this context, the provider may, for example, enable partners or even third parties to use this data to place advertisements within and outside the social media platform. If you use the social media platform on multiple end devices, the collection and evaluation may also take place across devices, especially if you are logged in as a user.

If you do not want cookies and/or cookie-like technologies to be used, you can also prevent them from being stored on your end device by making the appropriate settings on your end device and/or Internet browser or by using separate opt-out options. Please note that the functionality and scope of functions of our social media site may be limited as a result.
2.3 Direct contact
If you contact us directly via our social media page (e.g. by means of a personal message, messenger or a pre-filled form), the processing of your data provided therein (e.g. name, e-mail address, details of your vehicle) will only be for the purpose of recording and, if necessary, responding to your customer/prospect inquiry. We do not transfer this data to internal systems.
As far as the initiation of a contractual relationship is concerned, the processing of data transmitted in the context of a direct contact via the social media platform is based on Article 6(1)(b) DSGVO. Insofar as you are asked by us for consent to data processing, e.g. by means of a checkbox in connection with forms provided by us, the legal basis for data processing in this respect is Article 6(1)(a) DSGVO, if applicable.
Since we are not aware of the confidentiality of the information you provide when contacting us directly or how it is used by the provider itself, please refrain from transmitting sensitive data or other confidential information, such as application documents, via this channel. 2.4 Other user interactions
In accordance with the way a social media platform works, it is possible for us to learn about users who like, subscribe to, rate, comment on, or share our social media site and posts, provided that you have made your interaction on the social media platform public and have not explicitly marked it as “private” using the social media platform’s settings, if applicable. We evaluate this information in aggregate form in order to provide our users and visitors with more relevant content that may be of greater interest to them. The information obtained in this way does not allow any conclusions to be drawn about a natural person.
In your respective social media profile, you as a user have the option, for example, to actively hide your “posts”, “tweets”, “rated videos”, “subscriptions”, “followers” or other profile information or to no longer follow or subscribe to our social media page. Then you will no longer appear in the list of followers or subscribers of this social media page.
2.5 Interest based advertising
We are able to use demographic and geographic analyses of our target groups provided to us by the provider in order to display targeted interest-based advertisements on our social media site or to highlight our posts, but without gaining direct knowledge of the identity of the user or visitor to whom the advertisements are displayed. In this case, the display of advertisements or highlighting of posts on our social media site is based on an analysis of prior usage behavior by the provider, whereby we only have anonymized or pseudonymized information that regularly does not allow us to identify you personally and is never merged with any personal data we may have stored.
If, in the context of interest-based advertising, we exceptionally carry out a so-called extended comparison with customer lists, this will only be done after you have given us your consent (Article 6(1)(a) DSGVO).
3. Recipients of personal data
Internally: Within Emoving GmbH, only those persons have access who need this for the purposes stated in each case.
External: We only pass on your personal data to external recipients outside Emoving GmbH if this is necessary for processing or handling your request, if there is another legal permission or if we have your consent for this.
External receivers are usually:
- Processor: Agorapulse SAS, a software provider from EU for the management of Social Profiles.
- Public authorities: Authorities and state institutions, such as public prosecutors, courts or tax authorities, to which we must transfer personal data for legally compelling reasons. The transfer is then made on the basis of Article 6(1)(c) DSGVO.

4. Data processing to third countries
Data processing by the respective platform provider regularly also takes place in third countries outside the EU/EEA, such as the USA in particular. 5. Data subject rights
As a person affected by the processing of personal data, you are entitled to the rights listed below. These rights result from the requirements of the Data Protection Regulation and are reproduced here in a partially simplified form.
5.1 Right to information
Pursuant to Art. 15 EU-DSGVO, you have the right to request confirmation from us as to whether personal data relating to you is being processed. If this is the case, you have a right to information about this personal data and the information referred to in Art. 15 (1) Hs. 2 EU-DSGVO. This includes in particular the purpose of the processing, the categories of data processed, the recipients to whom data has been or will be disclosed, as far as possible the planned duration of storage or the criteria for the duration of storage.
5.2 Right to rectification
Pursuant to Art. 16 EU-DSGVO, you have the right to demand that we correct any inaccurate personal data relating to you without undue delay. Taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data – also by means of a supplementary declaration.
5.3 Right to deletion
Pursuant to Art. 17 EU-DSGVO, you have the right to demand that we delete personal data relating to you without undue delay. We are obliged to delete personal data without undue delay if one of the reasons listed in Art. 17 (1) EU-DSGVO applies. These reasons include, for example, that the data is no longer necessary for the purposes for which it was collected or otherwise processed.
5.4 Right to restriction of processing
Pursuant to Art. 18 EU-DSGVO, you have the right to demand that we restrict processing if one of the conditions specified in Art. 18 EU-DSGVO applies. This includes, for example, that you dispute the accuracy of the personal data. Then we may only process the data in a restricted manner for as long as it takes to verify the accuracy of the personal data.
5.5 Right to data portability
Pursuant to Art. 20 EU-DSGVO, you have the right to receive the personal data concerning you that you have provided to us in a structured, common and machine-readable format. You have the right to transfer this data to another controller, i.e. another entity that processes data, without hindrance, provided that the original processing was based on consent or was necessary for the performance of a contract.
5.6 Right of objection
Pursuant to Art. 21 EU-DSGVO, you have the right to object at any time to the processing of personal data concerning you, if this data is processed on the basis of Art. 6 (1) e) or f) EU-DSGVO and there are reasons arising from your personal situation. You may object to the processing of data for the purpose of direct marketing at any time. Personal data will then no longer be processed for this purpose. The right to object can be exercised by means of an informal declaration. A written statement or, optionally, an e-mail to the above contact address is sufficient.
5.7 Right to revoke the declaration of consent
According to Art. 7 (3) EU-DSGVO, you have the right to revoke your consent to processing at any time. The lawfulness of the processing carried out on the basis of the consent until the revocation is not affected. The right of revocation can be exercised by an informal declaration. A written declaration or, optionally, an e-mail to the above contact address is sufficient. You can withdraw your consent to the use of cookies via our banner, which is displayed when you access our privacy policy.
5.8 Automated decision in individual cases including profiling
Pursuant to Art. 22 EU GDPR, you have the right not to be subject to a decision based solely on automated processing – including profiling – which produces legal effects concerning you or similarly significantly affects you. Article 22 (1) of the EU GDPR provides for exceptions to this right, although Article 22 (4) of the EU GDPR in turn provides for partial exceptions.
5.9 Right to complain to a supervisory authority
Pursuant to Art. 77 EU GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, your place of work or the place of the alleged infringement, without prejudice to any other administrative or judicial remedy, if you consider that the processing of personal data relating to you infringes this Regulation.
